1. What Funding Today does

Funding Today is a business funding broker. We collect information about your business’s funding needs, present your request to independent funders in our network that may be able to help, and help you understand and compare the offers they make. Funding Today is not a lender or funder. We don’t make credit decisions, set prices or terms, or advance money.

A merchant cash advance is generally structured as a purchase of a portion of a business’s future receivables rather than a loan. How a particular agreement is treated depends on its terms and on applicable law.

2. Who can use our services

Our services are only for businesses, not for personal, family or household purposes. To submit a request you must be at least 18 years old and authorized to act for a business located in the United States. Funding Today does not accept requests from businesses located in California.

3. Information you provide

You agree that the information you give us is true, accurate and complete, and that you will tell us if it changes. You authorize Funding Today to share your request and supporting information with funders that may be able to make an offer, and you authorize us and those funders to verify the information you provide. Our Privacy Policy explains how we handle your information.

4. Calls, texts and email

If you agree on our application, Funding Today and the funders it works with may call and text you about business funding at the number you provide, including with automated dialing technology and artificial, prerecorded or AI-generated voices. This permission is not a condition of any purchase. You can withdraw it at any time in any reasonable way, including by replying STOP to a text or calling (208) 748-6200. Message and data rates may apply.

5. No guarantee of funding

Submitting a request does not guarantee that you will receive an offer, approval, a particular amount, price, payment structure or funding time. Each funder applies its own review, which may include checking your credit, bank activity and business records. Any timing we describe, such as funding in as little as 24 hours, is an example of what can happen with some funders and is not a promise.

6. Agreements with funders

Any funding agreement is between your business and the funder you choose. Funding Today is not a party to it and is not responsible for a funder’s decisions, performance or collection practices. Read every agreement carefully before you sign, including the total amount you will repay, how and how often payments are collected, fees, early payoff terms, and how disputes are handled. Where state law requires it, the funder must give you commercial financing disclosures before you sign.

7. How we are paid

Funding Today does not charge you an upfront or application fee for its brokerage services. If you accept an offer, the funder may pay Funding Today a commission or other compensation. The funder’s own fees, if any, will appear in its offer and agreement.

8. Estimates and information on the site

The cost estimator, examples, comparisons and news summaries on our site are for general information only. Estimates are based on the numbers you enter and on simplifying assumptions, and they are not offers, quotes or commitments. Nothing on the site is legal, tax, accounting or financial advice. Check with your own advisers before making financial decisions.

9. Acceptable use

You agree not to:

• submit false or misleading information, or apply on behalf of a business you aren’t authorized to represent;
• use the site for any unlawful purpose or in violation of these terms;
• use bots, scripts or other automated means to submit forms or collect content from the site;
• interfere with the site’s security or operation, or try to gain unauthorized access to it.

10. Our content

The site and its content, including text, graphics, logos and the cost estimator, belong to Funding Today or its licensors and are protected by intellectual property laws. You may view and print pages for your own business use. Any other use requires our written permission.

11. Third-party sites and services

The site links to websites and uses services run by others, such as news sources, government agencies, funders and our live chat provider. We don’t control those sites or services and aren’t responsible for their content or practices.

12. Disclaimers

The site and our services are provided “as is” and “as available.” To the fullest extent permitted by law, Funding Today disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that the site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Funding Today will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising out of or related to the site, our services or any funding agreement, even if we were told such damages were possible. Our total liability for any claim related to the site or our services will not exceed $100. Some jurisdictions don’t allow these limits, so they may not apply to you.

14. Indemnity

You agree to defend and indemnify Funding Today against claims, losses and expenses, including reasonable attorneys’ fees, that arise from information you provided that was false, your misuse of the site, or your violation of these terms.

15. Resolving disputes

If you have a concern, please call us first at (208) 748-6200. Most issues can be resolved quickly and informally. If we can’t resolve a dispute that way, either of us may pursue it in a court of competent jurisdiction, subject to applicable law. Nothing in these terms limits any right you have under law that cannot be waived.

16. Changes to these terms and contact

We may update these terms from time to time. When we do, we will change the “Last updated” date above. Continuing to use the site after an update means you accept the revised terms.
